PLEASE READ THESE TERMS CAREFULLY BEFORE USING AIRPORTWX

By downloading, installing, or using AirportWX (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Beren Software ("we", "us", "our") regarding your use of AirportWX.

2. Description of Service

AirportWX is a weather information application that provides:

• METAR (current weather observations)
• TAF (terminal aerodrome forecasts)
• Push notifications for weather alerts
• Airport information and mapping

The App is intended for informational purposes only and should NOT be used as the sole source for flight planning or aviation decision-making.

3. ⚠️ CRITICAL DISCLAIMERS AND LIMITATIONS

3.1 No Liability for Weather Data Accuracy

YOU ACKNOWLEDGE AND AGREE THAT:

Weather data provided by AirportWX is sourced from third-party services (AVWX API) and may be:

• INACCURATE
• INCOMPLETE
• OUTDATED
• DELAYED
• UNAVAILABLE

• We do NOT guarantee the accuracy, reliability, completeness, or timeliness of any weather information displayed in the App
• Weather data may contain errors, omissions, or technical issues beyond our control
• WE ARE NOT RESPONSIBLE FOR ANY DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY THE APP

3.2 Not for Navigation or Flight Planning

AIRPORTWX IS NOT:

• An official aviation weather briefing service
• A certified flight planning tool
• A substitute for official NOTAMs, METARs, or TAFs
• Approved for use in flight operations or navigation

YOU MUST:

• Always verify weather information through official sources (e.g., aviation weather services, ATC, official aviation authorities)
• Obtain proper flight briefings from authorized sources
• Follow all applicable aviation regulations and safety procedures
• Use certified and approved tools for flight planning and operations

3.3 No Responsibility for Consequences

WE ARE NOT LIABLE FOR:

• Flight delays, diversions, or cancellations
• Safety incidents or accidents
• Property damage or personal injury
• Financial losses or business interruption
• Missed opportunities or scheduling conflicts
• Any other direct or indirect consequences resulting from:
  • Use or inability to use the App
  • Reliance on information provided by the App
  • Errors, inaccuracies, or omissions in weather data
  • App downtime, crashes, or technical issues

3.4 User Responsibility

YOU ARE SOLELY RESPONSIBLE FOR:

• All aviation decisions and operations
• Verifying all weather information through official sources
• Complying with all applicable laws and regulations
• Ensuring flight safety through proper procedures
• Using appropriate, certified tools for flight operations
• Your own safety and the safety of others

BY USING THIS APP, YOU ACCEPT FULL RESPONSIBILITY FOR ALL DECISIONS MADE BASED ON THE INFORMATION PROVIDED.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE PROVIDE THE APP "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content
• OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE LAST 12 MONTHS
• WE SHALL NOT BE LIABLE FOR:
  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Business interruption
  • Personal injury or death
  • Property damage

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5. Service Availability

5.1 No Guarantee of Uptime

We do not guarantee that:

• The App will be available at all times
• The App will be error-free or uninterrupted
• Weather data will be current or available
• Push notifications will be delivered successfully
• Third-party services (AVWX, APNs) will function properly

5.2 Maintenance and Updates

We may:

• Perform maintenance that temporarily interrupts service
• Update, modify, or discontinue features without notice
• Change or remove weather data sources
• Suspend or terminate the service at any time

We are not liable for any disruption or unavailability of the service.

6. User Obligations

6.1 Acceptable Use

You agree to:

• Use the App only for lawful purposes
• Use the App only for personal, non-commercial use
• Not reverse engineer, decompile, or attempt to extract source code
• Not use automated systems to access the App (bots, scrapers, etc.)
• Not attempt to overload or interfere with App servers
• Not transmit malware, viruses, or harmful code
• Comply with all applicable aviation laws and regulations

6.2 Prohibited Use

You may NOT use the App:

• As a substitute for official aviation weather briefings
• For commercial flight operations without proper certification
• In any way that violates aviation regulations
• To make critical safety decisions without verification
• In violation of any local, state, national, or international law

6.3 Account Security

You are responsible for:

• Maintaining the security of your device
• All activity that occurs through your device
• Unauthorized access to your device or push notifications

7. In-App Purchases and Subscriptions

7.1 Payment Terms

• All purchases are processed through the Apple App Store
• Prices are shown in your local currency and include applicable taxes
• Payment will be charged to your Apple ID account
• We do not have access to your payment information

7.2 Subscriptions

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours before the end of the current period
• You can manage and cancel subscriptions in iOS Settings > Apple ID > Subscriptions
• No refunds for partial subscription periods

7.3 Refunds

• All refund requests must be made through Apple
• We cannot process refunds directly
• Refer to Apple's refund policy: https://support.apple.com/en-us/HT204084
• No refunds for weather-related issues or data inaccuracies

7.4 Changes to Pricing

We reserve the right to:

• Change subscription prices at any time
• Modify features included in subscriptions
• Discontinue subscription tiers

Price changes will apply to new subscribers immediately and to existing subscribers at their next renewal date.

8. Intellectual Property

8.1 Ownership

• The App and all content, features, and functionality are owned by Beren Software
• Weather data is provided by third parties and subject to their terms
• Airport data is sourced from public databases (OpenStreetMap, etc.)
• All trademarks, logos, and service marks are property of their respective owners

8.2 License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Use the App for personal, non-commercial purposes
• Access weather data for personal reference only

You may NOT:

• Redistribute, resell, or sublicense the App or its content
• Use the App or data for commercial purposes
• Create derivative works based on the App
• Remove copyright notices or proprietary markings

9. Third-Party Services

9.1 Data Providers

The App relies on third-party services:

• AVWX API - Weather data provider
• Apple Push Notification Service - Notification delivery
• OpenStreetMap - Map data
• RevenueCat - Purchase management

We are not responsible for:

• Availability or accuracy of third-party services
• Changes to third-party terms or policies
• Third-party service interruptions or errors
• Third-party data privacy practices

9.2 External Links

The App may contain links to external websites or services. We are not responsible for:

• Content on external sites
• Privacy practices of external sites
• Availability of external sites

10. Privacy

Your use of the App is subject to our Privacy Policy, available at privacy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

11. Push Notifications

11.1 Notification Delivery

• Push notifications are delivered via Apple's servers (APNs)
• We cannot guarantee notification delivery or timing
• Notifications may be delayed, lost, or fail to deliver
• Network conditions, device settings, and server issues may affect delivery

11.2 Alert Accuracy

• Weather alerts are based on automated monitoring of METAR data
• Alerts may be triggered by incorrect, outdated, or incomplete data
• DO NOT rely solely on push notifications for weather awareness
• Always verify current conditions through official sources

11.3 Opt-Out

You can disable push notifications:

• In the App: Disable individual alerts or all alerts
• In iOS Settings: Settings > Notifications > AirportWX
• By uninstalling the App

12. Data Usage and API Limits

12.1 Fair Use

• The App is subject to API rate limits from AVWX
• Excessive use may result in temporary service interruption
• We reserve the right to limit or throttle requests

12.2 Service Costs

• Weather data retrieval incurs costs for us
• We may limit features or data access for free users
• Premium features may require a subscription

13. Modifications to Terms

13.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes will be:

• Posted in the App
• Effective immediately upon posting (or as stated in the notice)
• Notified through email or in-app notification for material changes

13.2 Continued Use

Your continued use of the App after changes to these Terms constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

14. Termination

14.1 Termination by You

You may stop using the App at any time by:

• Deleting the App from your device
• Disabling all alerts
• Cancelling any active subscriptions

14.2 Termination by Us

We may suspend or terminate your access to the App:

• If you violate these Terms
• For abuse or misuse of the service
• For non-payment (if applicable)
• At our sole discretion, with or without notice

Upon termination:

• Your license to use the App immediately ends
• You must delete the App from your device
• We may delete your data from our servers
• Active subscriptions will continue until the end of the paid period

15. Geographic Restrictions

• The App is available worldwide but may have restrictions in certain countries
• You are responsible for complying with local laws regarding aviation weather information
• Some features may not be available in all regions
• Weather data coverage varies by location

16. Indemnification

You agree to indemnify and hold harmless Beren Software, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Aviation decisions or operations based on App information
• Any injury, accident, or incident related to your use of the App

17. Dispute Resolution

17.1 Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

17.2 Jurisdiction

Any disputes arising from these Terms or use of the App shall be resolved in the courts of the Netherlands.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Beren Software regarding the use of AirportWX.

20. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

21. Assignment

You may not assign or transfer these Terms or your rights under these Terms. We may assign these Terms without restriction.
